HCS HB 2057 -- THE ESTABLISHMENT OF ENTERTAINMENT DISTRICTS

This bill allows for the designation of entertainment districts located in Osage Beach and Chesterfield that:

(1) Borders on or contains no less than 1,000 miles of lake shoreline or borders the Missouri river, as specified in the bill;

(2) Contain a combination of entertainment venues, bars, nightclubs, restaurants, and other licensed establishments and common areas; and

(3) Is designated as an entertainment district by way of an ordinance passed by the governing body of Osage Beach or Chesterfield.

Under the provisions of the bill, a person can apply for an entertainment district special license (license) to sell intoxicating liquor by the drink from one or more licensed establishments including, but not limited to, portable bars within the entertainment district on the following schedule:

(1) Until 1:30 a.m. on Mondays through Saturdays; and

(2) From 6:00 a.m. on Sundays through 1:30 a.m. on Mondays.

A license fee of $300 per year will be assessed.

An establishment holding a license may allow persons to leave the premises with an alcoholic beverage and enter upon and consume the alcoholic beverage within other licensed establishments and common areas located in portions of the entertainment district during the days and hours described in this bill. However, no person will take any alcoholic beverage outside the boundaries of the entertainment district.

Every licensee within the entertainment district must serve alcoholic beverages in containers that display the licensee's trade name, logo, or some other mark unique to that license and licensee. The licensee will be solely responsible for alcohol violations that occur on the premises, including any portable bar or common area.

The governing body of the city in which the entertainment district is located can adopt procedures for the approval or rejection of the entertainment district as well as regulations concerning conduct and enforcement thereof.
